1. Acceptance of Terms

By accessing or using namaa bloom ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use the Service. These terms apply to all users, including educators, school administrators, and any other individuals who access the platform.

2. Payment Processing โ€” Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns.

When you make a purchase through namaa bloom, you are entering into a transaction with Paddle.com Market Limited and agree to be bound by:

  • Paddle Checkout Buyer Terms
  • Paddle Privacy Policy

Paddle is responsible for collecting and remitting applicable taxes (including VAT and sales tax) on all transactions. The price displayed at checkout is the final price inclusive of all applicable taxes.

3. Description of Service

namaa bloom is an AI-powered platform that helps educators generate personalised, thoughtful student progress reports. The Service allows you to:

  • Create and manage student and class records
  • Build a personal observation bank
  • Generate AI-assisted written feedback reports
  • Deliver reports directly to families via email

AI content generation is powered by Namaabloom GenAI agents. While we strive for high-quality output, you are responsible for reviewing and approving all content before it is sent to families.

4. Subscriptions and Billing

Free Plan: namaa bloom offers a free plan with no payment required. Free-plan users may access core features subject to usage limits.

Paid Plans: Paid subscriptions are billed on a recurring basis (monthly or annually) via Paddle. By subscribing, you authorise Paddle to charge your payment method on each billing date until you cancel.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period. You will be charged the then-current rate unless you cancel at least 48 hours before the end of your current billing period. Renewal notices are sent by Paddle via email prior to each billing date.

Price Changes: We will give you at least 30 days' notice of any price changes. Continued use of the Service after a price change constitutes your acceptance of the new rate.

Taxes: All prices are displayed inclusive of applicable taxes. Paddle calculates and remits VAT, sales tax, and other applicable taxes on our behalf.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting Paddle's support. To avoid being charged for the next billing period, cancel at least 48 hours before your renewal date. Upon cancellation, you retain access to paid features until the end of your current paid period. No partial refunds are issued for unused time within a billing period unless required by applicable law or our Refund Policy.

6. Eligibility

The Service is intended for use by qualified educators and school staff. By using namaa bloom, you confirm that you have the appropriate authorisation from your school or institution to store student information and communicate with families on its behalf. You must be at least 18 years old to create an account.

7. Your Account

You may sign in using Google OAuth or an email magic link. You are responsible for maintaining the security of your account and for all activity that occurs under it. Please notify us immediately at hello@namaabloom.com if you suspect any unauthorised use.

8. Student Data Responsibility

You, as the educator, are the data controller for any student information you enter into the Service. namaa bloom acts as a data processor on your behalf. You must ensure:

  • You have the legal basis (e.g. school policy, parental consent) to store student names and observations
  • You do not enter sensitive special-category data (medical, religious, or disciplinary records) into the platform
  • Family email addresses used for report delivery are correct and appropriately authorised

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of school or institutional policies
  • Attempt to reverse-engineer, scrape, or disrupt the Service
  • Share your account credentials with others
  • Generate or distribute content that is abusive, discriminatory, or harmful to students or families
  • Misrepresent your identity or affiliation with any institution

10. AI-Generated Content

Reports generated by the Service are AI-assisted and should be treated as drafts for your review. namaa bloom does not guarantee the accuracy, appropriateness, or completeness of any AI-generated content. You are solely responsible for the final content of any report sent to families.

11. Intellectual Property

namaa bloom and its original content, features, and functionality are owned by namaa bloom and are protected by applicable intellectual property laws. You retain ownership of any original content you create, including your observation bank entries and customised reports.

12. Limitation of Liability

To the fullest extent permitted by law, namaa bloom shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to errors in AI-generated content, email delivery failures, or data loss. Our total aggregate liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. EU and UK Consumer Rights

If you are a consumer located in the European Union or the United Kingdom, you may have statutory rights that cannot be limited by these Terms, including rights under consumer protection and distance-selling regulations. Nothing in these Terms affects those statutory rights. For EU consumers, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

14. Complaints

If you have a complaint about the Service, please contact us at hello@namaabloom.com. We aim to respond within 5 business days. For billing and payment complaints, contact Paddle directly as they are the Merchant of Record. If your complaint is not resolved to your satisfaction, EU consumers may refer to their national consumer protection authority or the EU online dispute resolution platform above.

15. Termination

We reserve the right to suspend or terminate your access if you violate these Terms. You may delete your account at any time by contacting us at hello@namaabloom.com.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service at least 30 days before they take effect. Continued use after changes constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before any formal proceedings are initiated. Nothing in this clause affects the statutory rights of EU or UK consumers.
